All rate filings, programs or plans approved for use in the State of New Mexico by the Superintendent of Insurance are available for use by the Program.
The Program will insure only those risks where the property owner has acceptably reduced or eliminated hazardous conditions.
An equitable and fair rate will be computed recognizing all existing exposures and hazardous, except those of an environmental nature beyond the control of the property owner. The Program retains the ability to charge an adequate rate in all situations.
If existing hazardous conditions or exposures are not recognized by the rate computed by the Insurance Service Office of New Mexico, the risk will be referred to the Underwriting Committee for the purpose of determining an equitable and fair rate.
